Terms and Conditions for Day Tours Unplugged

Please read these Terms and Conditions carefully before booking any tour with Day Tours Unplugged ("we," "our," "us"). By booking a tour, you agree to be bound by these Terms and Conditions.
1. General
These Terms and Conditions govern the relationship between Day Tours Unplugged and you, the customer. Day Tours Unplugged operates tours in Ireland and facilitates bookings through its website daytoursunplugged.ie, using the FareHarbour booking platform.
2. Booking and Confirmation
- All bookings are made subject to these Terms and Conditions.
- To book a tour, you must follow the booking process on our website, which redirects to our secure booking platform powered by FareHarbour.
- Full payment is required at the time of booking to confirm your reservation.
- Upon successful booking and payment through FareHarbour, you will receive an email confirmation from FareHarbour, detailing your tour, date, time, and other relevant information. This email serves as your booking confirmation. Please check your spam folder if you do not receive it promptly.
- It is your responsibility to ensure that all details on your booking confirmation are correct. Please notify us immediately if you notice any discrepancies.
3. Pricing and Payments
- All prices are quoted in Euro (€) unless otherwise specified.
- Prices are subject to change without prior notice, but any changes will not affect bookings already confirmed.
- Payments are processed securely via FareHarbour's integrated payment gateways. We do not store your credit card details.
4. Cancellation and Refunds
4.1. Cancellation by the Customer:
- Free Cancellation Period: You may cancel your booking for a full refund up to [e.g., 24, 48, 72] hours before the scheduled tour start time.
- Late Cancellation: If you cancel within [e.g., 24, 48, 72] hours of the tour start time, no refund will be issued.
- No-Shows: If you do not show up for a tour at the designated meeting point and time, no refund will be issued.
- How to Cancel: Cancellations must be made through the FareHarbour booking system (if available) or by contacting us directly at info@daytoursunplugged.ie, providing your booking reference number.
- Refund Processing: Approved refunds will be processed back to the original payment method within [e.g., 5-10] business days.
4.2. Cancellation by Day Tours Unplugged:
- We reserve the right to cancel or postpone a tour due to unforeseen circumstances, including but not limited to:
- Insufficient number of participants (minimum [e.g., 2, 4] participants required for certain tours).
- Adverse weather conditions making the tour unsafe or unfeasible.
- Operational reasons (e.g., guide illness, vehicle breakdown).
- Events of Force Majeure (see Section 8).
- In the event of cancellation by Day Tours Unplugged, you will be offered an alternative date or a full refund. We will endeavour to notify you as soon as reasonably possible.
- Day Tours Unplugged will not be liable for any additional costs or losses incurred by you as a result of our cancellation (e.g., travel expenses, accommodation).
5. Changes to Tours
- Changes by Day Tours Unplugged: While we strive to adhere to the advertised itineraries, Day Tours Unplugged reserves the right to make minor changes to tour itineraries, routes, vehicles, or timings if necessary due to unforeseen circumstances, road conditions, local events, or operational reasons. We will endeavour to provide a comparable experience. Major changes will be communicated as per Section 4.2.
- Changes by the Customer: If you wish to change your booking (e.g., date, number of participants), please contact us at info@daytoursunplugged.ie. Changes are subject to availability and may incur an administration fee or price difference. Changes are generally not permitted within [e.g., 72 hours] of the tour start time.
6. Customer Responsibilities
- Arrival Time: It is your responsibility to arrive at the designated meeting point at least [e.g., 15 minutes] before the scheduled tour start time. Tours will depart promptly, and we are not responsible for late arrivals or no-shows.
- Fitness and Health: You are responsible for ensuring that you and all members of your party are physically able to participate in the chosen tour. Please inform us of any relevant medical conditions or mobility issues at the time of booking. We reserve the right to decline participation if we believe it poses a risk to your safety or the safety of others.
- Conduct: You are expected to behave in a respectful manner towards your guide, fellow participants, and the general public. Disruptive or inappropriate behaviour may result in your removal from the tour without refund.
- Instructions: You must follow the instructions of your tour guide at all times.
- Personal Belongings: You are responsible for the safety and security of your own personal belongings during the tour. Day Tours Unplugged is not responsible for lost, stolen, or damaged items.
- Children: Children under [e.g., 18] must be accompanied by an adult. Child prices (if applicable) are specified on the tour details.
- Insurance: We highly recommend that you obtain comprehensive travel insurance that covers personal injury, medical expenses, loss of luggage, and cancellation/interruption of your trip.
7. Liability
- Day Tours Unplugged acts as an organiser of tours. While we take all reasonable care to ensure the safety and enjoyment of our customers, we cannot accept liability for:
- Any loss, damage, injury, or death arising from your own negligence or failure to follow instructions.
- Loss or damage to personal belongings.
- Delays, inconvenience, or additional expenses caused by unforeseen circumstances, road conditions, traffic, or events beyond our control.
- Services provided by third parties not directly under our control (e.g., restaurants, attractions, independent transport providers, unless explicitly part of our package and under our direct supervision).
- Our liability for any claim arising from a tour is limited to the amount paid by you for that tour.
- Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation, or any other liability which cannot be excluded or limited by applicable law.
8. Force Majeure
Day Tours Unplugged will not be liable for any failure or delay in performing its obligations where such failure or delay results from any cause beyond our reasonable control, including, but not limited to, acts of God, war, terrorism, civil commotion, labour disputes, strikes, adverse weather conditions, natural disasters, epidemics, pandemics, government restrictions, or transport disruptions. In such cases, we will endeavour to offer alternative arrangements where possible, or a full refund as per Section 4.2.
9. Intellectual Property
The content of the Day Tours Unplugged website, including text, graphics, logos, images, and tour descriptions, is our property and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or use any content from our site without our express written permission.
10. Complaints
If you have a complaint during your tour, please bring it to the immediate attention of your guide so that we can attempt to resolve it on the spot. If the issue cannot be resolved during the tour, please submit your complaint in writing to info@daytoursunplugged.ie within [e.g., 7 days] of the tour date, providing all relevant details. We will investigate your complaint and respond as quickly as possible.
11. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Ireland. Any disputes arising out of or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of the Republic of Ireland.
12. Amendments to Terms and Conditions
Day Tours Unplugged reserves the right to update or modify these Terms and Conditions at any time without prior notice. Any changes will be effective immediately upon posting on our website. Your continued use of our services after any such changes constitutes your acceptance of the new Terms and Conditions.
